Terms of Service

HFT Spike is owned and operated by OMG FZE LLC, a Free Zone Entity registered in Ajman, United Arab Emirates. References to “we”, “us”, or “our” in these Terms mean OMG FZE LLC.

These Terms of Service (“Terms”) form a binding agreement between you and OMG FZE LLC governing your access to and use of hftspike.com, our software, and related services (collectively, the “Services”). By creating an account, purchasing a licence, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 18 years old and legally able to enter into a binding contract to use the Services. By using the Services you represent that you meet these requirements and that your use complies with all laws applicable to you.

HFT Spike provides a MetaTrader Expert Advisor (EA) and related trading software offered on a licence basis. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the software on the trading account(s) associated with your licence key, solely for your own use and in accordance with these Terms.

You are responsible for providing accurate information, for keeping your account credentials and licence keys confidential, and for all activity under your account. Notify us promptly of any unauthorised use. We may suspend or terminate accounts that contain false information or that are used in breach of these Terms.

You agree not to:

• copy, resell, sublicense, rent, or redistribute the software or your licence key;
• reverse engineer, decompile, or attempt to extract the source code, except where permitted by law;
• share, publish, or use a single licence across accounts beyond your entitlement;
• circumvent licence validation, usage limits, or security measures.

Paid plans may be offered as one-time purchases or recurring subscriptions. Subscriptions renew automatically for successive periods until cancelled, and the payment method on file is charged at the start of each period. You can cancel at any time before renewal; cancellation takes effect at the end of the current billing period. Prices are stated at checkout and may change on a prospective basis with notice.

Because the Services provide immediate access to digital software and licence keys, all sales are generally final and non-refundable, except where required by applicable law or expressly stated at the point of sale. If you believe you are entitled to a refund, contact us at [email protected].

Trading foreign exchange and other leveraged instruments carries a high level of risk and may not be suitable for all investors. You may lose some or all of your invested capital. Past performance and back-tested or simulated results are not indicative of future results. You use the software and make all trading decisions at your own risk.

OMG FZE LLC is a software provider. Nothing in the Services constitutes investment, financial, legal, or tax advice, nor a recommendation to buy or sell any instrument. You are solely responsible for evaluating the suitability of the software for your circumstances and for complying with the rules of your broker and jurisdiction.

The Services, including all software, text, graphics, logos, and trademarks, are owned by OMG FZE LLC or its licensors and are protected by intellectual property laws. Except for the limited licence granted to you, no rights are transferred to you.

The Services rely on and link to third parties, including payment processors, the MetaTrader platform, and the MQL5 marketplace. Your use of those services is governed by their own terms, and we are not responsible for their acts, omissions, or availability.

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that they will produce any particular trading outcome.

To the maximum extent permitted by law, OMG FZE LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any trading losses or lost profits, arising out of or relating to the Services. Our total aggregate liability for any claim shall not exceed the amount you paid to us for the Services in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless OMG FZE LLC and its officers, employees, and agents from any claims, losses, liabilities, and expenses arising out of your use of the Services or your breach of these Terms.

We may suspend or terminate your access to the Services at any time if you breach these Terms or use the Services unlawfully. Upon termination, your licence ends and you must stop using the software. Provisions that by their nature should survive termination will survive.

We may update these Terms from time to time. Changes take effect when posted on this page, and we will update the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Ajman, without regard to conflict-of-law principles. The competent courts and authorities of Ajman, United Arab Emirates shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.
